The short answer

Casino gambling in Texas requires amending the state constitution — a two-thirds vote in both chambers plus a statewide referendum. In the 2025 session both leading resolutions (SJR 16 by Alvarado, SJR 82 by Johnson) were filed, referred to Senate State Affairs, and never received a committee vote, let alone floor passage. With the legislature meeting in odd-numbered years only, no casino legalization can advance until the 2027 session at the earliest.

Neither resolution reached even a committee hearing. That is the pattern of the past decade: casino bills arrive with industry backing and polling support, then die quietly in committee under leadership resistance — particularly in the Senate, where the lieutenant governor controls the floor calendar.

Why the bar is constitutional

  • Article III of the Texas Constitution bans most gambling; exceptions (the lottery, charitable bingo, pari-mutuel racing) were each carved out by amendment.
  • Casinos need the same treatment: two-thirds of both the House and Senate to put the question to voters, then a statewide referendum.
  • The legislature convenes biennially in odd years — missing the 2025 window pushes the next opportunity to 2027 absent a special session.
  • Lt. Gov. Dan Patrick has repeatedly stated the Senate lacks votes for expansion; House passage alone changes nothing.
